AFSCME Local 2620 Wins Major PERB Victory for Members’ Rights
Another Win for Our Union. Another Win for Every Member.
AFSCME Local 2620 is proud to share an important victory before the California Public Employment Relations Board (PERB).
Following a hearing, PERB found that the California Correctional Health Care Services (CCHCS) at Richard J. Donovan Correctional Facility violated the Ralph C. Dills Act by issuing a Letter of Instruction (LOI) to a bargaining unit employee in retaliation for engaging in protected union activity. PERB also found that CCHCS unlawfully interfered with the employee’s protected rights and denied AFSCME Local 2620 its statutory right to represent employees.
As part of PERB’s order, CCHCS has been directed to:
Remove, rescind, and destroy all references to the unlawfully issued Letter of Instruction from the employee’s personnel file.
Cease retaliating against bargaining unit employees for exercising their protected rights, including speaking about workplace conditions and requesting union assistance.
Stop interfering with employees’ rights under the Dills Act.
Respect AFSCME Local 2620’s legal right to represent bargaining unit employees.
Why This Matters
This decision is about much more than one employee.
It sends a clear message that every AFSCME member has the right to raise concerns, seek union representation, and participate in protected union activities without fear of retaliation.
It also reaffirms that AFSCME Local 2620 is the exclusive representative of our bargaining unit and that management cannot interfere with our ability to advocate on behalf of members. When one member’s rights are protected, every member benefits.
